Lindsay Graham: "We Can't Pick and Choose Which Laws We Will Obey"

Lindsay Graham, who wants to president of the United States, told NBC's Andrea Mitchell, county clerk Kim Davis "can't pick and choose which laws she will and will not obey."

Graham says if she is allowed to do so she "would be just like President Barack Obama."

If true, why then is Kim in jail and there are no consequences to the president and the long list of other elected officials who have done exactly the same thing---and none are in jail nor have they been.

In fact most all of them continue to serve in high level, high profile and high paying elected positions.

Are decisions by the Supreme Court "rulings" or do they override the other two branches of government and create "law"?

Tipping point?


NBC's Mitchell did what she always does. She tried to pit Graham against comments made earlier in the day by Mike Huckabee, another Republican.

She said, "Mike Huckabee, one of your competitors, said on 'Morning Joe' today to Joe Scarborough that she [Davis] has the right to do that, because what the Supreme Court ruled isn't really law, that there is no statute involved in approving gay marriage."

Graham told NBC, "It's the law of the land until the Supreme Court changes their decision or there's a constitutional amendment overriding that decision."

Mike Huckabee had said earlier on MSNBC, "The only law she's following is the Kentucky law, which by constitutional amendment defines marriage as a man and a woman. The specific form that she is required to fill out for a marriage license specifically requires male and female," Huckabee said.

He also reminded the folks at NBC that he thinks we are getting close to what President Thomas Jefferson was concerned about: "'judicial tyranny' that would result if court rulings became law without action by the other two branches of government."

Huckabee said, "I think we're getting close to what Jefferson said if we allow the Judicial Branch just to make up law without the people's elected representatives, you turn the Constitution into a thing of wax."

"And that's why I believe it's time for us to have a real clear understanding of something that we should have learned in 9th grade civics---that the Supreme Court is not the Supreme Branch, it's the Supreme Court. And it certainly is not the Supreme Being. It cannot overrule the laws of nature or the laws of nature's God."

Chief Justice John Roberts, in his dissent, said of the Court's ruling on marriage, "It is the interpretation of 5 unelected lawyers on the court."

Huckabee is not the only one speaking out.

Ted Cruz, also a candidate for the presidency, said Judge Bunning's jailing of county clerk Kim Davis is "judicial tyranny."

Cruz, an attorney himself, asked, "Where is the call for President Obama to resign for ignoring and defying our immigration laws, our welfare laws, and even his own Obamacare laws?"

Cruz said, "When the mayor of San Francisco and President Obama resign, then we can talk about Kim Davis."

He said, "Today, judicial lawlessness crossed into judicial tyranny. Today, for the first time ever, the government arrested a Christian woman for living according to her faith"---reminding the press that "In dissent, Chief Justice John Roberts rightly observed that the court's marriage decision had nothing to do with the Constitution. Justice Scalia observed that the court's decision was so contrary to law that state and local officials would choose to defy it."

Both were right.

It won't be only Kim Davis, others will follow.

This move by an activist judge against a county clerk may well be a tipping point in American culture. People are fed up with the direction elitist secular progressives are pushing this country.

This is not Europe. Americans are not Europeans. We resisted a misguided king in 1776, and we will resist misguided want-a-be kings in 2015.

That resistance has begun on several fronts.

An Oregon judge, Judge Vance Day, has told Associated Press he will not conduct same-sex marriages for the same reason Kim Davis will not issue the licenses.

He is a biblical Christian.

He says he actually made the decision awhile back.

He is now "under investigation" for several allegations, but the Commission on Judicial Fitness says the "issue of same sex weddings is the weightiest" issue.

A Seattle pastor, who is an immigrant from Russia, told me in regard to the courts and the marriage issue, "This reminds me of what I fled in Russia."

Ohio's Supreme Court is already warning judges that if they refuse to marry same-sex couples on "personal, moral or religious grounds," they will be punished.

Penny Nance, president of Concerned Women for America, says that Davis' "predicament is the direct result of the lawlessness promoted by the Supreme Court of the United States itself with its unconstitutional Obergefell decision."

White House spokesman Josh Earnest defined the hypocrisy when he said Friday, "There's a rule of law and the principle of the rule of law is central to democracy..."

Why then is his boss, President Obama, so selective in choosing which laws he recognizes and which he does not.

The intensity in which the secular left punishes those who do not conform is stunning.

A leader in the Kentucky Legislature had asked Judge Bunning to delay his action against Kim Davis so the state legislature could provide a resolution regarding Davis. The judge refused to even allow the legislature to act.

People close to the issue are now saying the judge even denied Kim Davis her due process.

Part of why this issue will become a tipping point is because Americans are fed up with the tentacles of the gay rights agenda---they are undermining the foundations of America's most important institutions---the church, the family and marriage.

Last week, 200 high school girls walked off campus in protest to the school's "I don't know if I'm a boy or a girl" policy regarding restrooms on campus.

Another part of why this event will create a tipping point is because of the strident hypocrisy of the so-called "progressive" left and their ever changing values and principles.

When the lights are turned on this issue, Lindsay Graham, Carly Fiorina and other Republicans who seek high roles in leadership look less than promising as leaders, as they fall on the wrong side of this issue.

Many on the left look like hypocrites.

Heritage Foundation produced this list of 10 high flying politicians who have selectively decided which laws they chose to recognize, and which they do not. Please read the article for details. This is a partial summary:

California Governor Jerry Brown, while serving as Cal. A/G,  decided to not respond to legal challenges of Proposition 8 which defined marriage as between one man and one woman. The reason for his unwillingness to do the job he had been elected to do was because of his personal beliefs. He believed Prop 8 was discriminatory.

Kentucky Attorney General Jack Conway refused to defend Kentucky's law that bans same-sex marriage. He refused to do what he had been elected to do because "appealing the case would be defending discrimination."

Montgomery County (PA) Register of Wills, D. Bruce Hanes, began issuing same-sex "marriage licenses"despite Pennsylvania's ban on gay marriage. No jail time for him, even though he violated the law because of his beliefs.

Pennsylvania Attorney General Kathleen Kane declined to defend the state of Pennsylvania when she was listed as defendant in a 2013 lawsuit filed by the ACLU regarding the state's ban on same-sex marriage. Refused to do what she had been elected to do because of her personal beliefs.

Oregon A/G Ellen Rosenblum refused to defend state's law banning same-sex marriage saying, "State defendants will not defend the Oregon ban of same-sex marriage in this litigation." She acted on her beliefs, and contrary to the law, but no jail time for her.

Virginia A/G Mark Herring was elected in 2013 to uphold and defend the laws of the state of Virginia. After elected he announced,  "As Attorney General, I cannot and will not defend laws that violate Virginians rights." He told the state he would be siding with every homosexual couple who sued the state, rather than defending, as he was elected to do, the existing laws of the state, which included a ban on same-sex marriage.

There are more on the Heritage list, but the pattern is obvious.

They are picking and choosing which laws they will and will not obey or defend. Why are they not in jail?

Why then is Davis singled out for jail?

Why then is Oregon Judge Day singled out for "investigation."
