WA State A/G's Climate Change "Secrecy Pact" Being Sued

In March, Washington State Attorney General Bob Ferguson joined 15 other state attorney's general in forming what the Heritage Foundation calls a "secrecy pact" to punish those who violate---including those who speak against, Obama's "Climate Change" agenda.

Now they are being sued by 2 legal organizations for "jeopardizing free speech rights and government transparency laws."

It's well known that WA A/G Ferguson punishes those who don't believe in same-sex "marriage"---now it's climate change?

In secrecy.

I'm reminded of Thomas Jefferson's words: "If a nation expects to be ignorant and free...It expects what never has been and never will be."


Parents of 2 killed in Benghazi attacks have filed suit against Hillary Clinton, claiming she is responsible for the deaths of their children. The plaintiffs are Pam Smith of San Diego and Charles Woods of Portland. They are also suing Clinton for defamation over public statements she made about what prompted the attack on the American Embassy

At a press conference on March 29, A/G Ferguson and 15 other state attorney's general and Al Gore, announced that they had formed an "Unprecedented coalition" to "Defend Climate Change Progress Made Under President Obama and Push The Next President For Even More Aggressive Action."

WA A/G Ferguson said, "A problem like climate change is bigger than any one state. I look forward to working with the coalition on innovative solutions to combat and reverse the harmful effects of climate change."

The "innovative solutions" Ferguson and his friends seek may be a little too combative.

Now legal action has been taken against the group, with the lawsuit specifically directed at Rhode Island Attorney General Peter Kilmartin, who is part of the group.

The lawsuit filed July 27 is calling for Kilmartin to release certain documents, specifically the "Climate Change Conference Interest Agreement" that Kilmartin, along with 15 other attorney's general signed.

Although Kilmartin did not personally attend the press conference, he sent a representative and released a supportive statement.

The suit claims that Kilmartin's tactics in supporting Obama's climate change agenda violate Rhode Island state law.

The concern rests primarily in the "secrecy" of the "pact." The unwillingness to release information to the public.

While this will play out legally in the coming weeks, it appears that the attorney's general are attempting to use the legal position of a "common interest shield" to allow them to discuss and act on certain subject matter without transparency or public disclosure.

Chris Horner, a critic of Obama's policies and a close follower of this new "pact," says if these attorney's general prevail in the deal to keep select details secret, the ordinary citizen will be the loser.

He says, "It will mean they can create privilege for what are otherwise public records, even when shared with ideological activists and donors, so long as every one who wants to keep their scheming secret agrees in advance."

Does Ferguson's involvement in this violate Washington State law?

In reporting on this, the Heritage Foundation says, "In the past few months, leading political figures and academics who support Obama's policy on climate change have called for prosecuting those who disagree under the federal law known as RICO---the Racketeer Influenced and Corrupt Organizations Act."

Heritage says, "Congress passed RICO in 1978 for the purpose of prosecuting mob crimes," but now far Left progressives want to invert that law and "use it against organizations, corporations, and individual scientists who are not convinced that human activity is responsible for catastrophic climate change."

The only acceptable science is the "science" Al Gore and the far Left believe.

While this attempt on the part of state attorney's general to act in secret against non-believers in Obama's version of climate change does not effect all states, it does effect the following ones:

California, Connecticut, District of Columbia, Illinois, Iowa, Maine, Maryland, Massachusetts, Minnesota, New Mexico, New York, Oregon, Rhode Island, Virginia, Vermont, Washington State and the US Virgin Islands.

Founding Father Noah Webster warned, "If the citizens neglect their duty and place unprincipled men in office, the government will soon be corrupted; laws will be made not for the public good so much as for the selfish or local purposes. Corrupt or incompetent men will be appointed to execute the laws:, ...and the rights of citizens will be violated or disregarded."
