Democrats to Expand Number on Supreme Court?


It's called "packing the Court."

Given that President Trump has already placed two Justices on the Supreme Court midway through his first term, and Justice Ginsburg is 85 with failing health, and Justice Breyer is 80, the far Left is approaching panic regarding more nominees by President Trump.

Here's why the 2020 election is even more important and consequential than the 2016 election.

If you're paying attention, you've noticed that a herd of Democrats are rounding up for the stampede toward the Oval Office in the 2020 election. Some say as many as 40 Democrats may end up running for president in 2020.

Robert Natelson, a constitutional lawyer with the Independence Institute, told One News Now there's not much the Left can do right now to change the Court---"They don't have a lot of options in the short term. President Trump is in a pretty good position to appoint another justice and get the nomination approved."


However.


If the Democrats win the White House and Congress in 2020, Natelson is pretty sure they will attempt to "pack the Court."

There's good reason to think that.

Last month, The Washington Free Beacon published an article revealing that Democratic National Committee Chairman Tom Perez is not only talking about "packing the Court" but laying the groundwork to actually do so.

However, his plan is completely predicated on the Democrats winning the presidential and congressional election in 2020---which is only 22 months from now.

Demand Justice is an organization run by former Hillary Clinton spokesman Brian Fallon who took a leading role in the fight to defeat the nomination of Brett Kavanaugh.

Last month he hosted an evening of discussion on solutions to fix a "court in crises" now that Donald Trump has gotten two justices confirmed in his first 2 years in office.


Fallon introduced Perez with a speech on how proposals to "meaningfully reform the Supreme Court" and make those reforms a part of the Democratic Platform with candidates running for both the presidency and Congress must be taking place.

While Perez did not approve the proposed solutions, he certainly didn't discourage them.

When far Left secular progressives use the word "reform," they always mean "revise."

Immediately following Perez's speech, the first panel of the event featured Todd Tucker, who last November released a report calling for adding justices to the bench through Court expansion---know as "packing the Court."

The second and last panel of the evening of planning featured two more vocal advocates for court packing, far Left progressive activists Elie Mystal and Sean McElwee. Both gave impassioned calls to pack the courts.


"Packing the Court"


Tucker is pushing these 5 ways to "reform the Court:" Mystal, McElwee and thousands of other activists agree.

  • Adding justices to the bench through Court expansion;
  • Removing justices through impeachment;
  • Changing the Court’s jurisdiction;
  • Ignoring or overriding Court decisions; and
  • Amending the Constitution to authorize term limits, the election of justices, or the elimination of judicial review.
McElwee, who is also the leading advocate for abolishing ICE, said she would soon be in DC with the chair of the DNC and would be further making the case for "packing the court."

Ironically, our Constitution leaves the number of justices on the Supreme Court up to Congress. President Roosevelt tried this in the 1930s but failed when even those in his own party saw that it was a naked power grab.

However, the Constitution doesn't stand in the way. It provides only that there shall be "one Supreme Court." And it prescribes a chief justice, but otherwise gives Congress control over the number of justices.

The initial number of justices in 1789 was six. Before it was settled at 9, the number rose to 10. In 1801 the outgoing Congress, dominated by the Federalist Party, provided that at the next vacancy the tally would drop from 6 to 5. The goal was to prevent incoming President Thomas Jefferson from filling the slot. However, before the vacancy arose, a new Congress controlled by Jefferson's party raised the figure back to 6.

Natelson writes that conservatives "shouldn't assume a future scheme would fail."

He says, "The Democratic Party today is a good deal further left than the Democratic Party of 1937, and a lot less respectful of traditional institutions or of the Constitution."

He concludes, "I wouldn't expect a lot of Democrats to stand against the court packing."

Perez and the DNC have not made any public statements about this...yet.

But be sure it is under intense consideration as they prepare to take over the country.

Democratic Party leaders Hillary Clinton and Barack Obama have both publicly explained how the Left really feels about Christians and conservatives.

Speaking at a New York fundraiser, Hillary said "half of Donald Trump's supporters belong in a 'basket of deplorables'" because they are "racist, sexist, homophobic, xenophobic, and Islamaphobic."

And she told the Women In The World Conference that "deep-seated cultural codes, religious beliefs and structural biases have to be changed."

You will recall that Obama opined to a group of his followers that too many Americans still cling to their guns, Bibles, and religion.

John Jay, our first Chief Justice of the US Supreme Court, said this:
"Providence has given to our people the choice of their rulers, and it is the duty, as well as the privilege and interest of our Christian nation, to select and prefer Christians for their rulers."

Founding Father and second President of the United States John Adams said, "We electors have an important constitutional power placed in our hands..."

True. And never more important than today.
