Abortion: America's Un-Civil War

With the publication of a leaked copy of the Supreme Court's decision that strikes at the heart of Roe v Wade, America has gone to war with itself in a way we haven't seen since the war over whether one man can own another man.

Slavery.

This war is over whether a woman can legally kill her unwanted child.

Abortion.

The all-out war is being declared by the left after the Supreme Court's draft opinion on abortion was leaked to the news organization POLITICO.

Our 16th President was on the right side of his civil war. Our current President is not.

From "Court-packing" to outright violence, the radical Left in our country is advocating "what-ever-it-takes" to preserve the right to kill the unwanted unborn.

Be informed, not misled.

POLITICO said this yesterday, "The Supreme Court has voted to strike down the landmark Roe v. Wade decision, according to an initial draft majority opinion written by Justice Samuel Alito circulated inside the court and obtained by POLITICO."

"The draft opinion," they say, "is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision — Planned Parenthood v. Casey — that largely maintained the right." 

Justice Alito writes, “Roe was egregiously wrong from the start. We hold that Roe and Casey must be overruled,” he writes in the document, labeled as the “Opinion of the Court.” “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”

The leak.



A person familiar with the court’s deliberations said that four of the other Republican-appointed justices — Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett — had voted with Alito in the conference held among the justices after hearing oral arguments in December, and that line-up remains unchanged as of this week.

The three Democratic-appointed justices — Stephen Breyer, Sonia Sotomayor and Elena Kagan — are working on one or more dissents, according to the person. How Chief Justice John Roberts will ultimately vote, and whether he will join an already written opinion or draft his own, is unclear.

The document, labeled as a first draft of the majority opinion, includes a notation that it was circulated among the justices on Feb. 10. If the Alito draft is adopted, it would rule in favor of Mississippi in the closely watched case over that state’s attempt to ban most abortions after 15 weeks of pregnancy.

Roberts confirmed the authenticity of the draft opinion and said he was ordering an investigation into the disclosure.

“To the extent, this betrayal of the confidences of the Court was intended to undermine the integrity of our operations, it will not succeed. The work of the Court will not be affected in any way,” Roberts pledged in a written statement. “This was a singular and egregious breach of that trust that is an affront to the Court and the community of public servants who work here.”

Roberts swears he will find out who leaked the document.

He issued a rare and official statement. In it, he condemned the leaking of the draft opinion and classified the behavior as a "betrayal." 

Further, Roberts announced he has instructed the Marshal of the Court to launch an investigation into the leak. "I have directed the Marshal of the Court to launch an investigation into the source of the leak," he concluded. 

About 45 people have access to these documents. No draft decision in the modern history of the court has been disclosed publicly while a case was still pending. 

Jonathan Turley, a law professor at George Washington University, criminal defense attorney, and legal analyst tweeted, "The alleged leak of the opinion in Dobbs v. Jackson Women’s Health Organization is nothing short of breathtaking. It would constitute one of the greatest breaches of security in the history of the Court."

The reaction.



The reaction of President Biden, Nancy Pelosi, Hollywood, the mainstream press, and millions of minions for abortion is defined by their lack of sanctity for life.

Justice Alito writes, "Where the Constitution is silent, the American people govern themselves through their elections and elected leaders, not federal judges."

He says, "The permissibility of abortion, and the limitations upon it, are to be resolved like most other important questions in our democracy: by citizens trying to persuade one another and then voting. That is what the Constitution and the rule of law demand."

President Joe Biden reacted to the leaked draft opinion, criticizing the “radical” argument against a constitutional right to abortion.

“The idea that we’re gonna make a judgment that is going to say that no one can make the judgment to choose to abort a child based on a decision by the Supreme Court I think goes way overboard,” Biden said.

During his remarks, Biden falsely claimed that "all mainstream religions believe the beginning of human life is open to interpretation."

“Look, think what Roe says. Roe says what all basic mainstream religions have historically concluded — that the right — that the existence of a human life and being is a question. Is it at the moment of conception? Is it six months? Is it six weeks?”

The president failed to mention that the Catholic Church, of which he claims to be a member, teaches that life begins at the moment of conception.

“If this decision holds, it’s really quite a radical decision… it basically says all the decisions related to your private life — who you marry, whether or not you decide to conceive a child or not… what does this do?” he asked.

President Biden also warned that the constitutional right to gay marriage would be endangered as well-- calling this apparent decision a "fundamental shift in American jurisprudence."

I pray he's right.

Biden said he supported a congressional effort to codify Roe v. Wade into law but declined to say whether or not he supported breaking the Senate filibuster rules to ensure its passage.

Nancy Pelosi and Chuck Schumer reacted as expected.

Senate Majority Leader Chuck Schumer (D-NY) and House Speaker Nancy Pelosi (D-CA) sounded off on the matter with a joint statement. In it, they charged that "unaccountable conservative justices have ripped up the constitution with an abomination of decision that has yet to be made official."

“If the report is accurate," they said, "the Supreme Court is poised to inflict the greatest restriction of rights in the past fifty years – not just on women but on all Americans. The Republican-appointed Justices’ reported votes to overturn Roe v. Wade would go down as an abomination, one of the worst and most damaging decisions in modern history.”

“The party of Lincoln and Eisenhower has now completely devolved into the party of Trump,” they concluded. “Every Republican Senator who supported Senator McConnell and voted for Trump Justices pretending that this day would never come will now have to explain themselves to the American people.”

As you can imagine, pro-life conservatives and biblical Christians are taking a deep breath and thanking God for the apparent turn of events. And thanking Trump for his nominations to the Supreme Court.

Pro-life conservatives are hailing this ruling that will undo the 1973 Roe v. Wade decision that made abortion the law of the land.

“If the draft opinion made public tonight is the final opinion of the court, we wholeheartedly applaud the decision,” Susan B. Anthony List President Marjorie Dannenfelser said in a statement: “We also recognize the need for the pro-life movement to continue its existing work to support pregnant women and children in need,” Dannenfelser said.

She continued, "The American people have the right to act through their elected officials to debate and enact laws that protect unborn children and honor women. If Roe is indeed overturned, our job will be to build consensus for the strongest protections possible for unborn children and women in every legislature."

"This," pro-life citizens said, "is a landmark day for the sanctity of life."

The looming uncivil war.

Only God knows what lies ahead in the nation He has blessed so significantly. It won't be pretty.

The far-left progressives believe their "right" to abortion is so noble that any means to that end is justified.

It appears that 5 of the 9 Justices on the Supreme Court have concluded that our Constitution does not provide the "right" to kill unwanted unborn children.

On page 65 of the leaked High Court opinion, Justice Alito writes this:

"We do not pretend to know how our political system or society will respond to today's decision overruling Roe and Casey. And even if we did foresee what will happen, we would have no authority to let that knowledge influence our decision. We can only do our job, which is to interpret the law, applying longstanding principles of  "stare decisis, and decide the case accordingly."

"We, therefore, hold that the Constitution does not confer a right to abortion. Roe and Casey must be overruled, and the authority to regulate abortion must be returned to the people and their elected representatives."

It was John Adams---Founding Father and second U.S. President who said, "Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other."

This war is spiritual, not merely political.
