Special Counsel Jack Smith is winding down both federal criminal cases he brought against President-elect Donald Trump before they go to trial.
Yesterday, Smith filed a motion to dismiss the election interference case against Trump in the U.S. District Court for the District of Columbia, marking a major victory for the president-elect.
And the American people.

Smith admitted: "After careful consideration, the Department has determined that OLC’s prior opinions concerning the Constitution’s prohibition on federal indictment and prosecution of a sitting President apply to this situation and that as a result this prosecution must be dismissed before the defendant is inaugurated."
Moreover, Smith then filed a motion in the United States Court of Appeals for the Eleventh Circuit to dismiss an appeal in the documents case, which “will leave in place the district court’s order dismissing the indictment without prejudice as to him.” Smith cites the reasoning laid out in his motion to dismiss the election interference case:
For the reasons set forth in United States v. Trump, No. 23-cr-57, ECF No. 281 (D.D.C.) (filed Nov. 25, 2024) (moving to dismiss criminal prosecution as to defendant Trump in the United States District Court for the District of Columbia), the United States of America moves, pursuant to Federal Rule of Appellate Procedure 42 and Eleventh Circuit Rule 42-1, to dismiss the appeal in this case as to defendant Trump.
The moves mark the end of the federal prosecutions against the president-elect, leaving two remaining cases at the state level in Georgia and New York.
“Now even Jack Smith admits the Left’s lawfare against President Trump has failed,” David Bossie, president of Citizens United, said. “When President Trump returns to the White House on January 20, the rule of law will return with him.”
Steven Cheung, the incoming White House communications director, touted the enormous legal victories in a statement shared with Breitbart News on Monday, shortly after Smith’s filings.
“The American People re-elected President Trump with an overwhelming mandate to Make America Great Again. Today’s decision by the DOJ ends the unconstitutional federal cases against President Trump, and is a major victory for the rule of law,” Cheung said.
“The American People and President Trump want an immediate end to the political weaponization of our justice system and we look forward to uniting our country,” he added.
Trump already winning
Springfield, a city of 50,000 that lies between Columbus and Dayton garnered national attention months ago when President-elect Donald Trump and Vice President-elect JD Vance noted that the community had been inundated with thousands of Haitian migrants as a result of President Joe Biden’s immigration policies.
Many of the 10,000 to 20,000 Haitian migrants who arrived in Springfield over the last few years are in the United States on Temporary Protected Status (TPS), a quasi-amnesty program. Others were awarded parole after being released into the United States at the southern border.
The arrival of thousands of Haitians has driven up housing costs in Springfield, created more welfare dependency, and coincided with a surge in car crashes that police and firefighters must respond to.
With Trump and Vance’s election victory this month, Haitian migrants have told CBS News and The Guardian that they plan to flee to sanctuary jurisdictions like Chicago and New York City.
Some already have fled, the reports indicate. One Haitian woman said she knows of 10 family members and friends who have already left Springfield, while an immigration activist told The Guardian that “people are leaving.”
Vance, in particular, has accurately tied mass immigration to higher housing costs.
Springfield, for instance, has seen its housing supply bought up by landlords looking to jack up rents on newly arrived Haitian migrants willing to share apartments and pay much higher prices.
As a result, many native Springfield residents have been priced out of the market — unable to afford $2,000 to $3,000 for rent.
Vance says, “Twenty-five million illegal aliens competing with Americans for scarce homes is one of the most significant drivers of home prices in the country. It’s why we have massive increases in home prices that have happened right alongside massive increases in illegal alien populations under Kamala Harris’s leadership."
